As I had warned earlier, the government has asked that the entire EFF v AT&T case be thrown out per the State Secrets Privilege. This is, of course, a gross misuse of a legitimate government privilege that will most likely provide a quick death for our only recourse against the illegal spying program.
The EFF has responded, saying, "We think the government's right to conduct this program should be considered separately from the issue of whether a telecommunications firm has the right to break the law."
