Each power is supposed to be a check on the other. The executive has all the power to enforce the law, but cannot make it. If the president doesn't like a law, he may veto it. The legislature can make the law, but cannot enforce the law and cannot make law in violation of the Constitution. The Supreme Court cannot make its own law, and cannot enforce law, but has the last say on what laws are valid and how they ought to be applied and interpreted. Simple 4th grade politics, right? </p> <br /> <p> GWB, however, does not play by the rules. When he does not like a certain bill, he doesn't veto it. He has never vetoed a single law to date. Instead, he signs the bill into law. He then issues a '<a href="http://en.wikipedia.org/wiki/Signing_statement">signing statement</a>', a note announcing that he is not obliged to follow the law. He insists that, as president, no law has authority over the executive because of the clause in the constitution which reads "The executive Power shall be vested in a President of the United States of America." Of course, this clause was clearly not meant to mean the president is not subject to law (otherwise the constitution would not award veto powers to him because they would be meaningless.) In similar fasion, President Bush also ignores Supreme Court decisions and precedents whenever he pleases. He has already disobeyed over 750 laws since coming into office in 2001. </p> <br /> <p> He believes that he can get away with this because he doesn't think the Republican-dominated Congress will stand up to him. He is right. Hopefully the Democrats will retake the House this November, in which case impeachment is a certainty. But the Democrats - even with a Senate takeover - will never garner enough votes in the Senate to actually remove him from office. So, even if he is impeached, he will still be free to do as he pleases. Why? A variety of poorly thought out reasons. Here are some of the common complaints people have:</p> <br /> <br /> <p>"Wal-mart puts mom and pop stores out of business"</p> <br /> <br /> <p>"Wal-mart pays their employees low wages"</p> <br /> <br /> <p>"Wal-mart does a poor job of providing employees with health insurance"</p> <br /> <br /> <p> News flash to Wal-Mart employees: <strong>You don't have to work at Wal-Mart</strong>. It isn't mandatory. Get a job somewhere else! There are no laws compelling anyone to work for Wal-Mart. Personally, I don't think anyone - excepting high school students working part-time - should work in a Wal-Mart at all. I agree, they pay low wages and don't have a good insurance program. So, just don't work there. If people would just refuse to work there, Wal-Mart would be forced to treat its employees better. However, Wal-Mart wages aren't horrifically low as many would have you believe. The average Wal-Mart Sales Associate (the most common Wal-Mart job) makes $8.23 per hour, over $3 per hour more than minimum wage. The average full-time employee makes almost $10 per hour. Also, when people point out the fact that people who work for Wal-Mart make low wages, they forget that these people would probably be working somewhere else making the same low wages if Wal-Mart weren't around. In other words, Wal-Mart isn't quite holding people back from being millionaires.</p> <br /> <br /> <p> It is unfair to a law-abiding company to be specifically singled out by the government (with the exception of abusive monopolies), but that is exactly what has been happening to Wal-Mart. The state of Maryland has just passed a law mandating that all companies in the state with over 10,000 employees must spend at least 8% of their payroll on health care. Of course, Wal-Mart is the only company affected by the law. While we do need to make sure that everyone in the U.S. has health insurance, we need to do it in a way that does not specifically punish certain businesses in favor of others. </p> <br /> <br /> <p> When it comes to complaints about mom and pop stores, remember that Wal-Mart doesn't shut down them down - people do, by choosing to shop elsewhere. If the people in a community want to keep their mom and pop stores and don't want a Wal-Mart, then they are free to continue shopping at those stores. <strong>You don't have to shop at Wal-Mart</strong>. Trust me; if people don't shop at a Wal-Mart, it isn't going to hang around. But most people tend to like lower prices and convenience, so they end up shopping at Wal-Mart. If you really oppose Wal-Mart enough to force them out of town through government but you still shop there you are a hypocrite and someone should drive a truck into you.</p> <br /> <br /> <p> And why exactly does Wal-Mart have such low prices, anyway? Wal-Mart's size enables it to purchase goods in huge volumes for reduced prices, and they have a very efficient system in place managing inventory and buying to reduce losses from being overstocked or under stocked. Recently, retired AT&T technician Mark Klein has come forward and submitted an affidavit alleging that AT&T has equipment set up that monitors and diverts its customers’ internet traffic and phone calls to the NSA.<span> </span>The Electronic Frontier Foundation (EFF) has filed a class-action <a href="http://www.eff.org/legal/cases/att/" title="EFF's Class-Action Lawsuit Against AT&T for Collaboration with Illegal Domestic Spying Program">suit against AT&T, and has demanded that AT&T immediately cease this illegal activity. They have filed evidence that they say supports their claims, including documents explaining how the spying equipment works. Unfortunately, none of us are able to view the actual evidence for ourselves because it has been kept secret from the public.



In fact, we may never know what kind of evidence the EFF and Mark Klein have, because the case may never come to trial. The government can request that the court throw the entire suit out under the State Secrets Privilege. Hence, for the moment, we are all left to wonder whether the government is listening to our phone calls and reading our e-mails, and what it is doing – or with whom it is sharing – our information. <br /> <br /> </p> <h3>For anyone not yet convinced of the warrantless wiretapping program's illegality</h3> <p class="MsoNormal"> There is simply no question that the wiretapping program is illegal. Remember Nixon and <a href="http://en.wikipedia.org/wiki/Watergate" title="Watergate">Watergate</a>? At that time, our nation was grappling with the same questions as it now is with regard to presidential power and warrantless surveillance. It wasn't legal when Nixon did it. In fact, just so there would be no further confusion over the legality of a president or the executive branch wiretapping without warrants, Congress passed and President Carter signed a new law called the <a href="http://en.wikipedia.org/wiki/Foreign_Intelligence_Surveillance_Act" title="Foreign Intelligence Surveillance Act">Foreign Intelligence Surveillance Act</a>. This act made explicit the fact that warrants are required for surveillance. The act also spells out exactly how to legally wiretap. In addition, to allow the government flexibility in cases where it didn't have time to obtain a warrant, there is a special part that allows the government to wiretap immediately w/o warrant - provided they go back to a special FISA court after the fact to a special court later to obtain one. The FISA court has granted over 18,761 and rejected only 5. Furthermore, FISA has been updated 5 times since September 11, 2001, to adapt it to the demands of wiretapping a new type of enemy. <br /> <br /> </p> <p class="MsoNormal"> The administration has tried claiming that it can violate FISA because congress voted to go after Al Qaeda in Afghanistan in late 2001. It has also tried to claim that the US Constitution gives the president the authority to pick and choose which laws he or she wants to follow, and which ones he or she does not want to follow.
